Food Stall Agreement

Title of Contract: Contract for the Supply of Temporary Food Stall/s at the Viking Challenge (2-3 March 2024)

("Provider"), and Great Lakes United Football Club, with its principal place of business at 25 Water Street, Forster 2428 ("Organiser").
  1. Scope of Work: The Provider agrees to supply temporary food stalls for use during the Viking Challenge (Event), located at Harry Elliot Oval and Peter Barclay Sports Fields, Tuncurry 2428. The temporary food stalls shall be set up and operated by the Provider in accordance with the specifications provided by the Organiser.

  2. Term: This Contract shall commence on 1 March 2024 and shall continue until 3 March 2024, which shall coincide with the duration of the Event, unless terminated earlier in accordance with the provisions of this Contract.

  3. Responsibilities of Provider:
    • Provide to the Organiser, within 3 weeks of the commencement of the Event, approval from MidCoast Council to operate a temporary food stall, or proof of having submitted the online form “Temporary Food Stall Notification” on MidCoast Council’s website
    • Provider agrees to maintain appropriate insurance coverage for its operations during the Event, including liability insurance and provide to the Organiser a copy of the insurance/Certificate of Currency.
    • Provide temporary food stalls in compliance with the NSW Food Authority's "Guideline for Food Businesses at Temporary Events" https://www.foodauthority.nsw.gov.au/sites/default/files/2021-02/temp_events_guideline.pdf
    • Ensure that all food provided from the stalls complies with relevant food safety standards and regulations.
    • Provide adequate staffing to operate the stalls during the Event.
    • Maintain cleanliness and hygiene standards at the stalls throughout the duration of the Event.
    • Ensure that all necessary permits and licenses for the operation of food stalls at the Event are obtained.
    • Ensure that the temporary food stall has adequate power for the duration of the Event.
    • Ensure your stall can operate on the one (1) 10amp power supply provided by the organiser

  4. Inspections: The Provider agrees to permit any inspection of the temporary food stall by a MidCoast Council Environmental Health Officer. 

  5. Responsibilities of Organiser:
    • Provide necessary space and utilities for the setup and operation of the temporary food stalls.
    • Promote the presence of the food stalls at the Event to maximize foot traffic and sales.
    • Coordinate with the Provider regarding logistics and any changes to the setup or operation of the stalls.
    • Provide one (1) 10amp power supply to the provider.

  6. Termination: Either party may terminate this Contract upon 21 days written notice to the other party in the event of a material breach of this Contract by the other party.

  7. Governing Law: This Contract shall be governed by and construed in accordance with the laws of the State of New South Wales.

  8. Entire Agreement: This Contract constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings, whether written or oral.
